Terms and Conditions – TOM HARVEY LTD

1. Warranty

All work completed by TOM HARVEY LTD is covered by a 12-month warranty as standard.

The warranty excludes standard wear and tear, accidental damage, and misuse.

2. Payment Terms

Payment is due upon receipt of the invoice, unless otherwise agreed in writing.

Business clients have a 30-day payment period.

Late payments will incur a 2% daily interest charge.

A deposit is required for any works valued at £1,000 and over, unless otherwise specified.

Invoices must be paid upon job completion.

Invoice payments must not be delayed for quality control issues beyond 5 days.

If an issue arises with the work or any materials, only the disputed section of the invoice may be withheld, not the full amount.

For larger works, TOM HARVEY LTD may request an interim payment, even if this was not verbally mentioned prior to quote

acceptance, unless a tiered payment system has been agreed upon for larger projects.

3. Recal Policy

Clients have a 3-day recal period after job completion for any concerns or minor adjustments.

4. Workplace Conduct

TOM HARVEY LTD reserves the right to refuse work in any property where staff are subjected to verbal or physical mistreatment.

Clients must ensure a safe and accessible working environment, free from hazards that could pose risks to staff.

Any health and safety concerns raised by TOM HARVEY LTD must be addressed before work commences.

The client is responsible for informing our team of any potential hazards before work begins.

5. Materials and Surcharges

All materials used by TOM HARVEY LTD will comply with UK regulatory standards and be of mid-range quality.

We reserve the right to refuse client-supplied materials that do not meet our standards or that we are unfamiliar with.

A 20% surcharge will be applied to all materials we supply, covering handling, delivery, and management costs.

Any additional materials required beyond the initial estimate will be charged accordingly, with client approval.

All leftover materials supplied by TOM HARVEY LTD remain our property unless otherwise agreed.

6. Site Facilities

Our team has the right to use bathroom and water facilities at any property where work is being carried out unless otherwise

specified.

7. Project Delays and Cancellations

TOM HARVEY LTD is not liable for delays caused by unforeseen circumstances, including but not limited to extreme weather, supply

chain disruptions, or third-party contractor delays.

Cancellations within 48 hours of the agreed start date may be subject to a cancellation fee.

If work is halted due to issues beyond our control, including access restrictions or lack of payment, rescheduling fees may apply.

8. Timeline

Any timeline provided during the quote process or upon approval is a general estimate and should not be considered a guaranteed

completion date.

There may be instances where projects take longer than anticipated due to unforeseen circumstances.While we will always strive to complete work in a timely manner, TOM HARVEY LTD will not be held responsible for hotel costs,

financial losses, or inconvenience caused by delays.

9. Liability and Insurance

TOM HARVEY LTD holds public liability insurance; however, we are not responsible for pre-existing damage or structural issues

uncovered during the work.

Any changes to the agreed scope of work must be documented and may result in additional charges.

We are not liable for accidental damage to personal property that has not been moved or adequately protected by the client.

10. Waste Disposal

We will remove all job-related waste unless otherwise agreed. However, larger waste removal, such as old furniture or excessive

debris, is the client's responsibility unless included in the contract.

Hazardous waste disposal is not included in standard services and must be arranged separately.

11. Access and Working Hours

The client must provide reasonable access to the property during agreed working hours.

If access is restricted and results in delays, additional charges may apply.

Standard working hours are Monday to Friday, 8 AM – 5 PM, unless otherwise agreed.

12. Use of Third-Party Contractors and Subcontractors

TOM HARVEY LTD may use third-party contractors or subcontractors to carry out certain aspects of the work.

All third-party contractors and subcontractors working under TOM HARVEY LTD will be covered by our insurance.

TOM HARVEY LTD will handle all communications with third-party contractors to ensure smooth project execution and quality control.

We are not responsible for any delays or issues caused by third-party contractors but will take reasonable steps to resolve them

efficiently.

13. Data Protection

TOM HARVEY LTD complies with UK data protection laws, ensuring that all client information is handled securely and confidentially.

Personal data will only be used for business and communication purposes and will not be shared with third parties without consent,

except when required to complete contracted work.

Clients have the right to request access, correction, or deletion of their personal data in accordance with GDPR regulations.

14. Equal Rights and Fair Pay

TOM HARVEY LTD is committed to equal rights and fair treatment of all staff, contractors, and outsourced customer service

representatives.

All workers are paid fair wages, in line with industry standards and employment laws.

We do not tolerate discrimination, harassment, or unfair treatment within our workforce or subcontractor network.

We ensure that all third-party customer service staff and subcontractors are treated with respect and fairness, maintaining a

professional and inclusive work environment.

By agreeing to our services, you accept these terms and conditions as part of the contractual agreement between you and TOM HARVEY LTD.
